3rd Case – Kennedy

When the city of Beaufongier prohibits the Santeria religion from sacrificing animals, they are not only taking away the rights and privileges from our citizens, but they also heartlessly removing a vital element of the Santeria religion. As the 14th amendment states, “no state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States,” and by keeping this law in place, the city of Beaufongier is denying the peoples right and privilege to practice and express their treasured religion. Also, the first amendment clearly states that “Congress shall make no law respecting an establishment of religion, or prohibiting the free excersise thereof.” This just goes to show that it is simply unconstitutional to forbid the rituals and sacrifices that are crucial to the Santeria religion, which is why I, Justice Anthony Kennedy, am ruling in favor of the plaintiff.
